EEC classifies polymer-modified road binders in 2715 from 22 Nov

The Board of the Eurasian Economic Commission (EEC) has ruled in Decision No. 132 of 20 October 2026 that a mixture based on petroleum products modified with polymers, used as a binder for road surfaces, is classified in heading 2715 (2715 00 000 0) of the EAEU Commodity Nomenclature of Foreign Economic Activity (TN VED). The decision was published on 23 October 2026 and takes effect on 22 November 2026.

Which products fall under the decision

The decision does not cover every polymer-bitumen product. It applies to a mixture with a specific composition and properties. According to the text of the decision, it is a homogeneous mixture intended for the construction and repair of various types of road surfaces. The base is one or more products of vacuum distillation of fuel oil (other than lubricating-oil distillates) with the addition of:

The decision describes a mixture with the following physical and mechanical parameters:

Legal basis and duty rate

The classification rests on General Rule for the Interpretation of the Nomenclature 1, that is, on the terms of the heading and the relevant notes. Heading 2715 covers bituminous mixtures based on natural asphalt, natural bitumen, petroleum bitumen, mineral tars or mineral tar pitch, for example, bituminous mastics and asphalt mixtures for road surfaces. The Explanatory Notes to the EAEU nomenclature group the products of this heading by end use, including waterproofing and protective compounds as well as products for road surfaces.

According to the IFCG reference database, the import duty on code 2715 00 000 0 is 5%. For petroleum bitumen, subheading 2713 20 000 0 in heading 2713, the reference database also shows 5%. The decision itself only determines the classification of the mixture and contains no provisions on the duty rate.

What this means for declarants

The decision was adopted under the first subparagraph of Article 22(1) of the EAEU Customs Code and sets a single approach to classifying a specific type of goods. For importers and customs brokers, applying the decision involves matching the product description in the declaration against the composition criteria and the values in quality certificates and test reports against the list above. The decision contains no provisions on the classification of mixtures with a different composition or properties.

It is not the only classification decision of the Board this month: Decision No. 130 of 13 October 2026 concerns a slewing bearing.
