26.10.2026 Regulation #EU #China #Import #Duties
EU to register imports of Chinese silicon and PVC from four countries
The European Commission has made imports of silicon from China, and of PVC from China, Korea, Mexico and Taiwan, subject to registration. Both regulations (2026/2346 and 2026/2345) were adopted on 23 October, published in the Official Journal on 26 October 2026 and enter into force the next day, 27 October 2026. Registration lasts nine months from entry into force.
Silicon: registration alongside a review of the existing duty
The measure covers silicon containing less than 99.99 % silicon by weight, currently classified under CN code 2804 69 00 (2804) and originating in China. An anti-dumping duty under Regulation (EU) 2022/1394 is already in force on this product, extended to consignments from Korea and Taiwan (2026/2346).
On 1 September 2026 the Commission opened an interim review of these measures under Article 11(3), following a request from Euroalliages dated 8 July 2026. The applicant speaks for producers representing 100 % of EU industry and argues that the duty at its current level no longer offsets injurious dumping. The Commission introduced registration on its own initiative to collect detailed data on imports after the investigation period and inform the action needed to restore the effectiveness of the measures. At this stage the Commission does not consider it appropriate to estimate the amount of future liability (2026/2346). Registration covers silicon of Chinese origin; consignments from Korea and Taiwan are not mentioned in the regulation.
PVC: registration to allow duties to be levied retroactively
Registration covers suspension (S-PVC) and bulk (M-PVC) polymerised PVC in pure form, not mixed with other substances. Emulsion PVC (E-PVC) is excluded. The product falls under CN code ex 3904 10 00 (3904), TARIC codes 3904 10 00 15, 21, 80 and 81 (2026/2345).
The anti-dumping investigation was opened on 23 September 2026 on a complaint lodged on 10 August 2026 by the PVC Trade Committee on behalf of producers accounting for more than 25 % of EU production. Registration is meant to ensure that, if the necessary conditions are met, duties can be levied retroactively on registered imports. Whether those conditions are met will be assessed in any regulation imposing definitive duties (2026/2345).
The complaint estimates dumping margins of 84–273 % for China, 21–61 % for Korea, 65 % for Mexico and 13–39 % for Taiwan, with injury elimination levels of 68 %, 53 %, 55 % and 56 % respectively. The Commission notes these figures are for information only (2026/2345).
Possible liability would normally be set at the lower of the dumping or injury level (Article 9(4)). If the investigation finds evidence of raw material distortions in China (claimed in the complaint; Article 7(2a)), the amount would be set at the dumping margin under Article 7(2b), provided it is concluded that a duty lower than the margin would not be sufficient to remove the injury to the Union industry (2026/2345).
What this means for importers
Registration does not itself impose duties: EU customs authorities must take steps to register the imports. It covers:
- silicon originating in China;
- S-/M-PVC originating in China, Korea, Mexico and Taiwan; emulsion PVC is excluded.
For PVC, registration is meant to allow duties to be levied retroactively if the conditions are met. For silicon, the data is collected for the review of existing measures.
